One Acre Exemption

Under the state exemptions to the bankruptcy act allowable under the law of a large southwestern sate, there is a one-acre exemption for the debtor's home. Two brothers, Robert and Lyle Quest are forced into involuntary bankruptcy due to some precious metal speculations. Robert lives in a penthouse atop a $62million office building he owns. Lyle's penthouse is a top a $71 million building that he owns. Each claims the one acre due under the state law.

The creditors claim that they should be able to reach all the value in the one acre except for the $15,000 exemption allowed by the federal law.

Who will win? Explain.

Violating Bankruptcy Laws

Mark is greatly upset and wonders if he should report what appears to him to be a flagrant abuse of the bankruptcy law. The individual debtor in question has been living for years in a house that is worth at least $100,000 and maybe much more. Recently, the debtor went through a bankruptcy, yet he and his family still live the house.

Is such a result possible without violating the bankruptcy laws? Explain.

Pension...

One month before being forced into bankruptcy Lyle retired from his position as president of the brothers' company. He then began drawing an amount equal to his old salary ($4 million per year) as his pension. He claimed that the pension was exempt from his creditors' claims as the state exemption mirrored the federal exemption in the area.

Smith rented an apartment from Jerry on a month-t0-month basis for $700 per month. At the time Smith first saw the apartment, there was a large tear in the carpet right behind the entryway door. The carpet there often bunched up and it was easy to trip on if you didn't notice it. On Saturday, Smith was entertaining guests when her boss arrived. The boss ran the doorbell and let herself in when no one answered. She then tripped on the torn rug, fell and broke her arm.She sued both Smith and Jerry for her medical expenses, lost wages, and pain and suffering. Smith is nearly broke, but Jerry her landlord is a multi-millionaire.

Is Jerry liable? Explain.

Showing Your Appartment

Three weeks before you are scheduled to move out of an apartment, the landlord tells you that he wants to begin showing the apartment to to other prospective tenants.

Moya rented an apartment in a large complex owned by Johnson. Moya's guest, Perkins, was injured when he fell on the icy sidewalk leading up to the building where Moya's apartment was located. Perkins sued both Moya and Johnson.

Failed Heating Unit

In the midst of a very cold winter, the central heating unit in Manlie's apartment complex failed. Several tenants notified the landlord, who happened to be out of town. Unless action were take immediately, all the pipes in the building would burst. The cost of the repairs was less than $50, but no one wanted to spend the money.

What were the tenants'duties in this situation? Explain.

Vine Street Office

Church and Jaspers planned to remain in their Vine Street offices only until their one-year lease expired on June 1. On May 15 they entered into a two-year lease for new office space on Seventeenth Avenue. This lease was to commence June 1. On May 25 Church and Jaspers discover that the occupant of the Seventeenth Avenue Offices whose lease expires on May 31, had not vacated and does not plan to do so until June 15.

Can Church and Jaspers remain in their old offices until June 15? Explain.

Apartment Lease

You moved into an apartment some time ago under a lease which identified the ending date as December 31. You plan to move out as of December 31 but do not tell the landlord. Two days before the lease expires, while you are packing, your landlord appears and informs you that because you did not give notice of your intent ot leave you owe rent for an additional month.

Brass Bowls

Taipei Yang ordered 900 solid brass bowls for indoor plants from the East-Meets-West Company, which imports such goods from Singapore. Yang had included the bowls as a special in his holiday gift catalog and expected to generate a net profit of at least $9,000 from their sale. When the shipment arrived and was opened, Yang scratched the bottom of a bowl and determined that it was sell with a surface plating of brass. Yang complained to the supplier, who pleaded ignorance and apologized. Nothing further was aid and Tang paid the full price. Three months later he thought he should get a reduction in price because of the defect.

Kitchen Remodel

In January, Doolan Construction Company promised to remodel Kemper's kitchen during July when Kemper would be visiting relatives in Canada. Their written contract, called for work to start on July 1, and to be completed before August 2. In April  Doolan phoned and said he could not start the job before July 2, if then.

What can Kemper do?

Uniforms

Your school orders 50 new uniforms for its marching band. The contract states that "time is of the essence," and if the goods are not received in time for the first performance by the band on September 1, the old uniforms will be used for another year. The manufacturer does not deliver the uniforms until September 3.

Can the school cancel the contract?

Emergency Surgery


The Franklins, Ali and Lomalinda, had no medical insurance and urgently needed money for emergency surgery for their infant child. They could not qualify for a bank loan and they didn't belong to a credit union. An acquaintance referred them to someone's name Slye, who'll lend you money on sight. No collateral. No credit report. Just show him you've got a steady job. The Franklins borrowed $2500 from Slye and agreed to pay $325 on the first of each month in 12 easy installments. Later a lawyer told them that the loan contract was illegal.

A door-to-door salesperson appeared at Jamaya's front door selling encyclopedias. Caryn offered to tutor Dottie in business law for six hours on the day before the final exam in return for $100. Dottie responded, "Let me think about it for a day, okay?" Green v. County School Board of New Kent County (1968)

States and counties adopted many different plans to desegregate their schools. In 1965, the New Kent County school board adopted a "freedom-of-choice plan," which essentially allowed students in the rural, residentially integrated district to choose which of the two schools they wished to attend-the formerly all black Watkins School or the formerly all-white New Kent School. After three years of the new plan, no whites had elected to attend Watkins and only 115 blacks attended New Kent. The black school children in this case contended that the "freedom-of-choice plan" in practice operated to perpetuate the racially dual (segregated) school system. It placed the burden of desegregation on the black children's shoulders.

If you were a Supreme Court justice, would you rule this "freedom-of-choice plan" constitutional?

Swann v. Charlotte-Mecklenberg Board of Education (1971)

The school district in question was a part-urban, part-rural district covering 550 square miles and serving 84,000 pupils in 101 schools. The school population was 29 percent black and those pupils were concentrated in one quadrant of Charlotte. Even after the Brown v. Board of Education decision, more than half of the black students attended schools without any white students or teachers. After the Green decision, the federal district court adopted a plan to scatter the highly concentrated black-student population by transporting students. The plan would involve 13,000 students and require 100 new buses at a cost of millions of dollars.

If you were a Supreme Court justice, would you order the desegregation of this school district through a busing system to disperse students?

Keyes v. School District No. 1, Denver Colorado (1973)

This was one of the first cases dealing with school segregation outside of the South. In this case, the lower courts found that the Denver School District deliberately engaged in discrimination in the Park Hill section of the district by building schools in certain areas, gerrymandering student attendance zones, and by the excessive use of mobile classroom units, among other things. The petitioners in the case not only wanted the Park Hill section of the city to be desegregated, but wanted the courts to order desegregation of all segregated schools in the city of Denver, particularly the heavily segregated schools in the core city area, even though there was no evidence of a deliberate attempt to segregate students in all-black schools there.

If you were a Supreme Court justice, would you order the entire district desegregated, or just the Park Hill area?

Milken v. Bradley (1974)

This case concerned the segregation practices of the Detroit school district, which was the fifth largest in the nation in 1970. Several black students and the NAACP filed the suit against the Detroit school district alleging past and present discrimination in the Detroit system, particularly in the drawing of school district and attendance zone boundaries. Lower courts found that there was discrimination and ordered the system to desegregate. Because of white flight to the suburbs, the Detroit school district was largely black, making it difficult to truly desegregate. A plan was devised to include surrounding majority white school districts in the desegregation plan, even though those districts had not engaged in any illegal segregation. This was believed necessary because without their participation, there could not be a racial balance in Detroit's schools.

Football Stadium vs. Prison

Voters faced two proposals on the ballot. One would build a new football stadium. Another would build new prisons. There is only enough money available to do one.

Are voters being asked to make an ethical decision? Who is affected?

Love

Bill was madly in love with Jennifer. He couldn't think about anything else. He daydreamed in his classes and was close to flunking out of school.

Does Bill's daydreaming in class have an ethical component? Who is most affected by this? Is Bill letting reason or emotion  determine his conduct?

Taxes

Your neighbor thought the tax system was corrupt. He thought it was far too complicated to be fair in the treatment of most people. So he refused to pay his taxes. He wrote the IRS expressing his views. When tax liens were filed against his property he used the occasion to publicize the unfairness in the tax system.

Is this civil disobedience? Why or why not?

Prime Time Restaurant

Staub, Conly, and Winfield were employees of the Prime Time Restaurant. They were aware that the owner never checked the totals on the sales checks against the cash in the register. Therefore it would be very easy to steal from the cash register. However, they did not steal. When asked why they gave the following reason  Staub said he didn't take the money because he was afraid of being caught. Conly said she didn't take the money because she felt obligated to obey the law. Winfield said he didn't take the money because of his religious beliefs.

To which person do you best relate? Why?

Shoplifting

Crawford was caught shoplifting by a store detective. The police were called, and he was arrested. When his parents came to bail him out of jail, they asked him why he did it. Crawford responded that he had applied for a summer job at the store, but he wasn't hired. He thought he was treated unfairly, and this justified the shoplifting.

Jan was trying to decide whom to vote for in an upcoming election. After reviewing the candidates she said, "I've decided to vote for Gary because I just feel better about him."
