Collision


Moser had no automobile liability insurance, although state law required it. She negligently collided with Chang's car. Chang threatened to call the police if Moser failed to pay $1,000 for pain and suffering and $2,000 for car repairs. Moser gave Chang a check for $3,000. Then she stopped payment on it.

If Chang sues, will she recover? Explain.

  1. I don't believe she will recover. She would lose since she is breaking the law. Chang would win the court case. Moser would owe Chang the money for pain and repairs. That is all.

  2. It depends. She could recover since they agreed on $3000 and she paid the full fine. She could also not recover since she drove without insurance. Either way is possible. It depends on the attorneys.

  3. Moser does have the insurance to pay for the accedent. So if Chang does sue moser wil have the insurance that will pay for it. The insureance my be different and wont let her have the whole thing payed for. It all depends on the insurance. Moser is covered.

  4. i dont think chang will recover because they threatened moser into a contract. the true way to deal with this situation would be to take it to court. it is Moser's fault for not having the required insurance. Moser is also responsible for the crash and needs to pay. Judge Judy would make moser cry.

  5. I don't believe that she will recover. She did't have any automobile liability insurance and she was supposed to have it. So she can get fined for that. Cause she isn't accepting the law.

  6. I don't think that Chang will recover. Moser had no automobile insurance.Chang would need to give Moser money for car repairs and any hostpital fees.

  7. No. Moser agreed to pay for the pain and suffering and the vehicle and did. They agreed that the $3000 would be paid in order for the cops not to be called. Moser also had no liability insurence either. it could possible go either way.

  9. Moser will still have to paid the set amount of 3,000. For the suffering, pain, and car repair. But in court Chang will not get anymore money. Moses will have to still laid the 3,000, court fines, and get insurance.

  10. No she will not recover. She didn't have liability insurance. That is illegal so Chang would definitely win in court. Moser would still owe money for all the damage done. Chang did threaten though.
