Icy Sidewalk

Moya rented an apartment in a large complex owned by Johnson. Moya's guest, Perkins, was injured when he fell on the icy sidewalk leading up to the building where Moya's apartment was located. Perkins sued both Moya and Johnson.

Who is liable, Moya or Johnson? Why?

  1. Johnson is liable. Maya has no jurisdiction of the property outside of the building. Maya is only responsible for her apartment. Johnson is the owner and he should be sued. He should've maintained the sidewalk.

  2. Johnson is liable. Moya has nothing to do with anything outside the apartment. Moya is responsible for things that go on inside not outside.
