Apartment Lease

You moved into an apartment some time ago under a lease which identified the ending date as December 31. You plan to move out as of December 31 but do not tell the landlord. Two days before the lease expires, while you are packing, your landlord appears and informs you that because you did not give notice of your intent ot leave you owe rent for an additional month.

 Is the landlord right? Explain.

  1. No. There should be a date in your lease. Since it was unspecified you can do that. Also since you're not going over your lease it's ok. That is all.

  2. No he isn't. He cannot force you to stay. He cannot force you to pay for something you aren't doing. Since you were already leaving anyways it should be pretty apparent. Yeah.

  3. It depends on if the lease stated that there had to be a certain amount of time stated before you move out. In this situation the Landlord is not right because this does not say that I had to state a certain amount of days before that i was leaving. Plus ontop of that I would be moved out by December 31, therefore i did not go past the date said.
